Terms of Service | Generative Income

Welcome to Generative Income ("we," "us," "our," or "Company"). These Terms of Service ("Terms") govern your access to and use of generative-income.ai and all related tools, resources, courses, and digital products (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. Account Registration

To access certain features, you may need to create an account. You agree to:

Provide accurate, current, and complete information during registration.
Maintain and update your account information.
Keep your password secure and confidential.
Accept responsibility for all activity under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Use of AI Tools

The Services include AI-powered tools and features. By using them, you understand and agree that:

AI-generated outputs may be inaccurate, incomplete, or outdated.
You are solely responsible for reviewing, evaluating, and verifying all AI-generated content before use.
AI outputs do not constitute legal, financial, tax, medical, or other professional advice.
AI tools are educational and informational — they support but do not replace human judgment, expertise, or professional consultation.
We may update, modify, or discontinue any AI feature at any time without prior notice.

4. AI-Generated Content Ownership

You retain ownership of the prompts, inputs, and data you provide to the Services.
To the extent permitted by applicable law, you own the rights to outputs generated from your inputs using the Services.
You grant Generative Income a non-exclusive, worldwide, royalty-free license to process your inputs solely to provide, maintain, and improve the Services. This license does not include the right to sell your content to third parties or use it for advertising without your consent.
We do not claim ownership of your outputs. However, due to the nature of AI systems, outputs generated for different users from similar inputs may be substantially similar. We do not guarantee that your outputs will be unique.

5. Output Use Restrictions

You may use AI-generated outputs from the Services for your personal and business purposes. However, you may NOT:

Represent AI-generated outputs as the work product of a professional service (e.g., present an Offer Architect output as a deliverable from a consulting engagement you are charging for, without substantial modification and your own professional judgment applied).
Resell, redistribute, or sublicense raw AI-generated outputs to third parties as a standalone product or service.
Use outputs to build a competing product, tool, or service.
Bulk-generate outputs for the purpose of resale, content farming, or populating third-party platforms.
Remove or obscure any attribution to Generative Income where outputs include it.

You ARE permitted to:

Use outputs as a starting point and substantially modify, adapt, and incorporate them into your own work.
Share outputs with your team, contractors, or collaborators for internal business use.
Reference or quote outputs in your own content with attribution to Generative Income.

In short: use the outputs to build your business — do not pass them off as your own professional work product without adding real value.

6. Prohibited Uses

You agree not to use the Services to:

Violate any applicable local, state, federal, or international law or regulation.
Generate content that is harmful, threatening, abusive, harassing, defamatory, fraudulent, or infringing on the rights of others.
Attempt to extract, reverse engineer, decompile, or otherwise access the source code, algorithms, prompts, or underlying systems of the Services.
Use automated systems (bots, scrapers, crawlers) to access the Services without written permission.
Interfere with the security, integrity, or performance of the Services.
Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
Use the Services to build a competing product or service.
Share, resell, or redistribute access to paid features or content.

7. Intellectual Property

All materials on the site — including but not limited to text, graphics, logos, software, AI system prompts, scoring algorithms, course content, frameworks, and methodologies — are owned by or licensed to Generative Income and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, or publicly display any proprietary materials without our prior written consent.

"Generative Income," the Generative Income logo, "Generative Income Builder," and all product names (including but not limited to Scrap or Scale, Builder Profile Diagnostic, Offer Architect, Prompt Mastery Lab, Visibility Engine, Brand Voice Builder, SOP Builder, Workflow Architect, Content Distribution Accelerator, AI Platform Selector, Operations Assessment, and Revenue Systems Coaching) are trademarks of Generative Income. Unauthorized use is prohibited.

8. Purchases & Digital Products

Pricing for all products is displayed at the point of purchase and is subject to change.
Payment is processed through Stripe, a secure third-party payment processor. Generative Income does not store your credit card information.
All purchases are governed by the Refund & Cancellation Policy.
Pro membership subscriptions renew automatically at the then-current rate unless canceled before the renewal date.

9. Subscription Terms (Pro Membership)

Pro membership is available at $39/month or $349/year.
Subscriptions renew automatically unless canceled.
You may cancel at any time through your account settings or the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period.
Upon cancellation, you retain access to Pro features until the end of your paid period. After that, your account reverts to free-tier access.
We reserve the right to change subscription pricing with 30 days' notice. Price changes do not affect your current billing cycle.

10. Earnings & Performance Disclaimer (FTC Compliance)

Generative Income provides education, tools, and frameworks — not guarantees.

We do not guarantee:

Any specific level of earnings or income.
Business outcomes or professional results.
That the use of our tools or courses will result in financial gain.

Any examples, case studies, or testimonials shown are illustrative only, represent individual experiences, and are not typical results. Your results will vary based on your skills, experience, effort, market conditions, and many other factors outside our control.

11. Third-Party Services

The Services may integrate with or link to third-party services (e.g., Stripe for payments, OpenAI and Anthropic for AI processing, Supabase for data storage, Perplexity for research capabilities). We are not responsible for the practices, content, or availability of third-party services. Your use of third-party services is governed by their respective terms and privacy policies.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

GENERATIVE INCOME, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO GENERATIVE INCOME IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
YOUR EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE SERVICES.

13. Indemnification

You agree to indemnify, defend, and hold harmless Generative Income and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

Your use of the Services.
Your violation of these Terms.
Your violation of any applicable law or the rights of any third party.
Content you submit, post, or transmit through the Services.

14. Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions.
Any dispute arising from or related to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, conducted in the State of North Carolina.
You agree to resolve disputes on an individual basis. Class actions and class arbitrations are not permitted.
Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction in North Carolina.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, Refund & Cancellation Policy, and all other legal documents referenced herein, constitute the entire agreement between you and Generative Income regarding the Services.

17. Changes to These Terms

We may update these Terms at any time by posting the revised version on this page with an updated "Last Updated" date. Material changes will be communicated via email or a prominent notice on the site. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
